Invectivity on the web: the protection of privacy and personality, civil liberties, and the constitution of (digital) public spher (P)
Subject Area
Public Law
Term
from 2017 to 2021
Project identifier
Deutsche Forschungsgemeinschaft (DFG) - Project number 317232170
The Research Project investigates how democratic constitutions deal with invective expressions on the Internet. Central to the Project is a re-mapping of the relationship of rights to freedom of expression and rights to privacy and personality. In this context, the constitution of public sphere(s) ought to be the pivotal point in the formation of an adequate perspective. This is because public spheres are similarly to be considered as a fundamental condition of democratic constitution, and (in the dimension of the public/ publicity) as a criterion to distinguish freedoms of expression from rights to personality as well as a characteristic feature of invective Internet phenomena.
