Codification of European Securities Regulation

Subject Area Private Law
Public Law
Term since 2021
Project identifier Deutsche Forschungsgemeinschaft (DFG) - Project number 491884974

The DFG has been funding the research project "Codification of European Securities Regulation" since 1 February 2022. The aim of the application for further funding of the research project is to implement the legal findings on the added value, concept and content of an EU codification act covering access to capital markets and trading of securities on these markets. An EU codification law is to be drafted (European Capital Markets Code - ECMC), which is to be introduced into the legal policy discourse on the European Union's Capital Markets Union project. It must be clarified how the complexity of regulation can be reduced in a codification act and how modernisation approaches (already developed in the research project) can be implemented in norms. Finally, the task of developing a regulatory system within a European Capital Markets Code that implements the codification idea will have to be shouldered. It will also be necessary to take into account the fact that the European Union wants to achieve a transformation of the economy based on the concept of sustainability with the Green Deal and that the Capital Markets Union project wants to exploit the opportunities offered by the digitalisation of the financial markets. The research project also makes a contribution to legislative science in the European context.
